Protection & No Contact Orders Attorney in Ft. Collins

Criminal protection orders may be issued by Colorado Courts pursuant to a domestic violence or other criminal charges under Colorado Revised Statute 16-3-503 and could have serious repercussions on your life. The reality of these orders is that you can often find yourself effectively evicted from your own home if the protected person resides there. Violation of these orders, even if the violation is done with the consent of the protected party, is a crime with penalties sometimes exceeding those of the crime you were originally charged for.

Civil Protection Orders have some of the same possible pitfalls as Criminal Protection Orders. However, they can carry with them consequences that last a lifetime. While a Criminal Protection Order generally expires if the case is dismissed or the sentence is completed, often a Civil Protection Order will be made permanent, and will last indefinitely. One of the most surprising consequences is a lifetime ban pursuant to The Gun Control Act (GCA), codified in 18 U.S.C. § 922(g) on gun ownership and possession if you are the subject of a court order (often a Protection Order) prohibiting you from harassing, stalking, or threatening an intimate partner. Getting a Protection Order modified or dismissed comes with exacting requirements that are often difficult to understand and navigate.

Why should I have representation when dealing with a protection order or no contact order in Colorado?

If you want a Civil Protection Order lifted or modified, certain statutory requirements must be met. You must undergo two separate and specific backgrounds checks within a certain timeframe in relation to your petition to lift or modify being filed. At the hearing, the judge considers over 10 factors pursuant to § 13-14-108 in deciding whether or not to lift or modify your order. You will need an attorney experienced in dealing with Protection Orders in order to have the best chance of regaining your full civil rights.
