Protection & No Contact Orders Attorney in Fort Collins and Winter Park

Criminal protection orders may be issued by Colorado Courts pursuant to a domestic violence or other criminal charges under Colorado Revised Statute 16-3-503 and could have serious repercussions on your life. The reality of these orders is that you can often find yourself effectively evicted from your own home if the protected person resides there. Violation of these orders, even if the violation is done with the consent of the protected party, is a crime with penalties sometimes exceeding those of the crime you were originally charged for.

Civil Protection Orders have some of the same possible pitfalls as Criminal Protection Orders. However, they can carry with them consequences that last a lifetime. While a Criminal Protection Order generally expires if the case is dismissed or the sentence is completed, often a Civil Protection Order will be made permanent, and will last indefinitely. One of the most surprising consequences is a lifetime ban pursuant to The Gun Control Act (GCA), codified in 18 U.S.C. § 922(g) on gun ownership and possession if you are the subject of a court order (often a Protection Order) prohibiting you from harassing, stalking, or threatening an intimate partner. Getting a Protection Order modified or dismissed comes with exacting requirements that are often difficult to understand and navigate.

Our attorneys are available to provide representation in these unique and challenging cases.

Seeking a Protection Order?

If you are in need of a protection order yourself, our attorneys are able to navigate that process as well. The other party will need to be properly served with notice and the request must contain enough information for the judge to find imminent danger unlikely to stop without the issuance of a protection order.
Without a Protection Order, your harasser may contact you with fear of fines or jail time, and without fear of being charged with a misdemeanor- or even felony- in Fort Collins, Loveland, or Winter Park.

Why should I have representation when dealing with a protection order or no contact order in Colorado?

If you want a Civil Protection Order lifted or modified, certain statutory requirements must be met. You must undergo two separate and specific backgrounds checks within a certain timeframe in relation to your petition to lift or modify being filed. At the hearing, the judge considers over 10 factors pursuant to § 13-14-108 in deciding whether or not to lift or modify your order. You will need an attorney experienced in dealing with Protection Orders in order to have the best chance of regaining your full civil rights.

  • Brilliant

“The way Matthew handled my case was truly impressive. He’s a true strategist, tactician and advocate. He consulted with me on every legal move and had ideas that I would have never thought of. Matthew was very knowledgeable and shared his expertise upfront in the process regarding my case. He set proper expectations and provided excellent advice along the way. Matthew knows the court system very well and is an excellent communicator. I would venture to guess he’s the best lawyer in Northern Colorado and one of the only Super Lawyers who practices PI and Criminal Defense in Colorado.”

  • The Best Attorney

“I’m so glad we found Matt Haltzman to take care of our case. He was so easy to work with, kind, and really listened to us. It was such a pleasure working with him. He was so professional and all my worries were gone. I had complete faith in him and he got our entire case dismissed. It would have been devastating to us had he not been such a great lawyer. We barely had to do anything, one meeting and one court appearance and the whole thing was thrown out. I would recommend him to anyone. He worked really hard for us. He is very bright and excellent at what he does. Thank you Matt! You truly saved us.”
